Manager, Regulatory Compliance

Title:   Manager, Regulatory Compliance

 

Reports to: Director, Retail Operations with dotted line accountability to Controller, CEO and Board of Directors

Job Summary:

The Manager will be responsible for ensuring that the Company complies with all regulatory rules in all markets where it operates. The person will be an expert in regulatory affairs and will be the Company's principal point of contact with regulatory bodies including Public Utility Commissions, Federal, state and local authorities, ISOs and other entities that regulate and/or set or enforce industry rules. The Manager will be responsible for monitoring the Company's systems and processes and for ensuring that they are compliant. The person will also be responsible for licensing and related new market processes and for required regulatory and ISO reporting. The Manager will keep his fellow leaders, the CEO and Board of Directors (as appropriate) informed of key regulatory developments that could impact the Company.

This person will provide broad legal, regulatory and compliance support across the business, advising company executives and other stakeholders on a range of issues including complex commercial contracts, consumer protection regulations, PUC licensing and compliance, litigation, sales and marketing, key industry risks, intellectual property matters, and new market entries.

Summary of Essential Job Functions

  • Ensure compliance with applicable federal, state and local regulatory laws and market rules. Ensure that effective internal controls for ongoing regulatory compliance are in place.

  • Monitor market rules and regulatory developments to inform the organization and to ensure that the Company stays a step ahead of regulatory and market rules changes.

  • Collaborate effectively with the leadership team and other team members to ensure that the Company’s regulatory imperatives are understood and implemented.

  • Gain detailed understanding of operational processes that are governed by regulation and rules and ensure that the Company is compliant. Monitor operational compliance on an ongoing basis.

  • Manage the Company's regulatory calendar and ensure that all reports are filed on a timely basis.

  • Manage external regulatory counsel and consultants on projects requiring legal advice and/or specialized expertise and experience.

  • Work closely with the Information Technology and Operations to ensure that regulatory rules are fully and properly reflected in systems (billing, customer care, customer communications, IVR system, etc.) and processes.

  • Manage the Company’s library of documents (Terms of Service, Notifications, Contracts, etc.) and the creation of new documents to ensure compliance. 

  • Manage/coordinate the Company's response to any regulatory inquiries.

  • Attend selected regulatory conferences and visit regulators in various States on a regular basis.

Experience and Qualifications:
  • 5+ years in progressively responsible regulatory management roles, preferably in the retail energy industry.

  • Deep understanding of restructured competitive energy markets and regulatory and operational rules and translation of rules into operational and system processes.

  • Strong organizational, analytical and problem solving skills.   

  • An excellent team player with the ability to manage up and across to build, foster and nurture relationships across the Company and with 3rd party vendors.

  • Highly professional written and verbal communication and interpersonal skills including knowing when formality is required. 

  • Personable and outgoing in nature. Ability to motivate teams to produce quality materials within tight timeframes and simultaneously manage several projects.

  • Ability to participate in and facilitate group meetings. 

  • Ability to consistently listen to other executives and employees and to acknowledge and value their input and thoughts and requests and to provide clear, well understood, thoughtful and timely feedback

  • The person must be 100% reliable with information that they are responsible for producing, having and/or understanding.

  • Must be accountable and decisive when assessing information, making recommendations and for communicating regulatory matters to other managers, the CEO, and the Board of Directors as appropriate.

  • A strong sense of ownership is a necessity.
